If I recall the EULA for YouTube states that all uploaded material becomes the exclusive property of YouTube and you relinquish all rights to the material.

I would say that the *concept* of the EULA is the same as the concept of any contract; it's meant to solidify understanding between multiple parties about acceptable, unacceptable and required conduct.
