I can see the argument that says that this should have gone to trial to determine if the university should have made special arrangements for the defendant to remain housed in a different dorm even if nobody else was in that dorm for the intersession period (reading between the lines, that seems to be the argument made by Nero, and partially accepted by the majority opinion).
