Manju: ts good judicial temperment, we want our judges to ignore precedent (like kelo) in favor of the plain meaning of the text. we don’t want them to retaliate for past wrongs like jim crow by allowing the state the very authority to discriminate that led to jim crow in the first place. no tit 4 tat or eye 4 eye is our judicial stand.
